Practice of administration of the Beachprotectionline

Abstract

This thesis is centered around the practice of administration of the beachprotectionline. Furthermore, it is centered on wether or not the environment centres are following the same practice as the countys did. The idea behind the projekt is based on the deflections that came from the structural reform. On january 1st 2007, the stractural reform had its beginning; a reform of the public sector, which brought about the closing of the countys. Up until the structural reform, the administration of rural areas, was taken care of by the county’s, except the duneprotectionlines, which were administrated by the state. As a result of the structural reform, the administration of the rural areas lies with the municypalities, except the beachprotectionline and the duneprotectionline, which both are administrated by the the environment centres. Because of a widespread mistrust with the municipalities, Miljøministeriet has conducted af thorough review of the § 3-administration. This review came to the result that the municipalities are conducting the same practice as the countys. With this starting point, combined with the regulation of the municipalities through kvalitetsstyringsloven, it is chosen to focus on the environment centres under Naturstyrelsen. This project therefore centres around investigating how the practice of administration of the beachprotectionline, and furthermore, if the environment centres under Naturstyrelsen, are following the same practice as the countys did. The practice of administration is determined through af discussion of Naturklagenævnets published decisions, ”Naturklagenævnet orienterer”, which revolves around the beachprotection from naturbeskyttelseslovens § 15. Through the discussion, the decisions are divided into the following categories; Cadastral changes, Buildingstructural changes, Fencing and signage, Trailers and likewise, Changes in terrain and Diverse. Wether or not the environment centres are following the same practice as the countys did, is determined by investigating if the decisions made by the environment centres are similar to the decisions made by the countys. The result is compared to two reports, on of which, came up with definite changes in practice. These reports are respectively regarding the revision of the municipalties’ practice of administrations around the § 3-areas, and also another semesterreport regarding commercial signage in rural areas.

Specialet omhandler administrationspraksis af strandbeskyttelseslinjen, og i den forbindelse også om miljøcentrene følger samme praksis som amterne gjorde. Ideen til projektet tager sit udspring af strukturreformens omlægninger. Den 1. januar 2007 trådte strukturreformen i kraft; en reform af den offentlige sektor, som medførte nedlæggelse af amterne. Amterne havde før strukturreformen administrationen af det åbne land med undtagelse af klitfredningen, der lå ved staten. Efter strukturreformen har kommunerne overtaget administrationen af det åbne land, dog ikke strandbeskyttelsen og klitfredningen, som administreres af Naturstyrelsens miljøcentre. Miljøministeriet havde på baggrund af, at der var en udbredt mistro til kommunerne, udarbejdet et serviceeftersyn af kommunernes § 3-administration. Serviceeftersynet kom til det resultat at kommunerne fører samme praksis som amterne gjorde, med udgangspunkt i det og reguleringen af kommunerne gennem kvalitetsstyringsloven, vælges at fokusere på Naturstyrelsens miljøcentre. Projektet kredser derfor om at undersøge hvordan administrationspraksis er for strandbeskyttelseslinjen, og endvidere om Naturstyrelsens miljøcentre følger samme praksis, som amterne gjorde det. Administrationspraksis fastlægges gennem en diskussion af Naturklagenævnets offentliggjorte afgørelser, ”Naturklagenævnet orienterer”, omhandlende strandbeskyttelsen i naturbeskyttelseslovens § 15. Ved diskussionen er afgørelserne opdelt i kategorierne; Matrikulære ændringer, Bygningsmæssige ændringer, Hegning og Skiltning, Campingvogne og lignende, Terrænændringer samt Rest/diverse. Om miljøcentrene følger samme praksis som amterne, fastlægges ved at undersøge, om miljøcentrenes afgørelser er i tråd med amternes. Resultatet sammenholdes med to rapporter, hvor der i den ene var en tydelig praksisændring, rapporterne er henholdsvis serviceeftersynet af kommunernes administration af § 3-naturen og en tidligere udarbejdet semesterraport omhandlende reklameskiltning i det åbne land.
