Abstract

This thesis examines whether Danish restraining orders (tilhold) provide sufficient protection against domestic violence and compares them with Norway’s contact and visitation bans. The point of departure is the police’s preventive mandate and the range of protective measures available, of which restraining orders are the least intrusive. Using a legal-dogmatic analysis of statutes and case law, the thesis reviews the conditions, scope, procedure, duration, and sanctions associated with Danish restraining orders. A comparative analysis is then conducted against Norwegian law, where electronic monitoring (ankle bracelet) may be imposed to secure compliance. Finally, legal policy considerations address proportionality, necessity, and effectiveness. The analysis finds that the Danish and Norwegian regimes are broadly similar, but Norway has a stronger enforcement tool through electronic monitoring. The thesis suggests considering a comparable measure in Denmark to enhance protection against repeat violence.
