Specialet undersøger, hvordan små og mellemstore virksomheder (SMV’er) møder barrierer i offentlige EU-udbud, og om Europa-Kommissionens forslag til et nyt udbudsdirektiv fra 20. december 2011 reelt vil lette deres adgang. Med udgangspunkt i juridisk metode foretages en systematisk analyse af den gældende retstilstand og de foreslåede ændringer, struktureret omkring fire hovedområder: forenkling af dokumentations- og informationskrav, begrænsning af deltagelseskrav (især økonomisk formåen), brugen af konkurrencepræget dialog og innovationspartnerskab samt opdeling af kontrakter i delkontrakter og brug af underentreprise. Analysen vurderer samtidig, om ændringerne er forenelige med udbudsrettens grundlæggende principper om gennemsigtighed og ligebehandling. Hovedkonklusionen er, at forslaget kun delvist imødekommer de udfordringer, SMV’er oplever, og at de udvalgte ændringer i deres daværende form ikke fuldt ud realiserer målet om bedre markedsadgang for SMV’er, hvilket kan svække bidraget til EU’s 2020-målsætninger.
This thesis examines the barriers faced by small and medium-sized enterprises (SMEs) in EU public procurement and assesses whether the European Commission’s proposal for a new public procurement directive of 20 December 2011 would meaningfully improve their access. Using a legal (doctrinal) approach, it provides a systematic analysis of the existing legal framework and the proposed reforms across four focus areas: simplification of documentation and information requirements, limits on participation requirements (especially economic and financial standing), the use of competitive dialogue and innovation partnership, and the division of contracts into lots and use of subcontracting. The analysis also considers consistency with core procurement principles of transparency and equal treatment. The main finding is that the proposal only partially addresses SMEs’ challenges; in its then-current form, the selected amendments do not fully achieve the intended goal of easing SME access to public contracts, with potential implications for progress toward the EU 2020 objectives.
