Abstract
Dette speciale undersøger høringssvar fra organisationer, der repræsenterer voksne med fysisk eller psykisk funktionsnedsættelse og/eller sociale problemer, samt Dansk Socialrådgiverforening. Høringssvarene vedrører Ministeriet for Børn, Ligestilling, Integration og Sociale Forholds lovforslag af 9. december 2014 om ændring af Lov om Social Service, Lov om Retssikkerhed og Administration på det sociale område, Lov om Socialtilsyn og andre love. Forslaget fokuserede især på, hvordan tildelingen af sociale ydelser til voksne med funktionsnedsættelser og/eller sociale problemer skulle foregå. Høringssvar er de formelle svar, som berørte parter afgiver under lovgivningsprocessens høring. Formålet er at belyse, om og hvordan disse høringssvar kan have bidraget til, at ministeriet trak lovforslaget tilbage, før det blev sendt til behandling i Folketinget. Undersøgelsen bygger på Spector og Kitsuses claims-making teori, der her forstås som en måde at analysere, hvordan aktører definerer samfundsproblemer og argumenterer for løsninger i den offentlige debat. Randall og Shorts modificerede version af de to første faser bruges til at forstå ministeriets claims-making proces. Losekes model for claims-making strategier anvendes til at analysere, hvordan organisationerne og Dansk Socialrådgiverforening fremhæver de konsekvenser, de mener, lovforslaget kan have. Gennem dokumentanalyse identificeres, hvilke modpåstande der fremsættes i høringssvarene, og hvorfor. Resultaterne viser, at argumentationen mod ministeriets løsningsforslag på tværs af organisationerne er meget ens. Høringssvarene rejser modpåstande, fordi lovforslaget vurderes som uhensigtsmæssigt og som et utroværdigt forsøg på at løse de problemer, der opfattes som til stede i de berørte love. Desuden anvender organisationerne og Dansk Socialrådgiverforening gennemgående strategier til at tydeliggøre de problematiske forhold, som de mener, lovforslaget indeholder.
This thesis examines consultation responses from organizations representing adults with physical or mental disabilities and/or social problems, as well as the Danish Association of Social Workers. The responses address a bill presented on 9 December 2014 by the Ministry for Children, Gender Equality, Integration and Social Affairs to amend the Act on Social Services, the Act on Legal Security and Administration in Social Matters, the Act on Social Supervision, and other laws. The bill focused in particular on how social services should be allocated to adults with disabilities and/or social problems. Consultation responses are formal comments submitted by stakeholders during the legislative hearing process. The aim is to explore whether and how these responses may have contributed to the ministry withdrawing the bill before it was considered by Parliament. The study uses Spector and Kitsuse’s claims-making theory, understood here as a way to analyze how actors define social problems and argue for solutions in public debate. Randall and Short’s modified version of the first two phases is used to understand the ministry’s claims-making process. Loseke’s model of claims-making strategies is applied to analyze how the organizations and the association highlight the consequences they believe the bill could have. Through document analysis, the study identifies which counter-claims are made in the responses and why. Findings show that, across organizations, the arguments against the ministry’s proposed solutions are very similar. The responses raise counter-claims because the bill is seen as inappropriate and an unconvincing attempt to address problems perceived to exist in the affected laws. The organizations and the Danish Association of Social Workers also use consistent strategies to make clear the problematic conditions they believe the bill contains.
