Resumé
Captivation in nikah-marriages is a complex conflict, rooted in collective honour culture and negative social control committed by parallel legal societies. This thesis explores how the Danish authorities meet and handle the structural challenges, that the parallel legal society, honour culture and negative social control purposes, when handling cases about women in nikah-captivation. The study is based on 5 semi-structured interviews with representatives of relevant authorities. The findings reveal that the victim’s emotional state, breaking from social norms and subcultural identity, directly affects her power of action. This power of action determines how- and if the authorities can intervene. This study finds that the surrounding parallel legal society confines the victim, through restricting her from legal consciousness, supervising and limiting her contact to the authorities, and labeling the decisions of the authorities as illegitimate. Therefore, the authorities need specialized knowledge and governance-networks, in order to overcome the social power of the parallel legal society. However, these conditions are limited by geographical fluctuations, unclear liability arrangements and limited resources in general, which creates structural challenges. This thesis concludes, that captivation in nikah-marriages must be solved through a systematic effort, that combines criminal, social and security measures. In order to address both the individual dynamics of violence, and the collective norm systems in which the captivation is rooted.
