Abstract
This thesis examines legal gender recognition in Malta and Romania within the European Union. It explains why recognition on official documents matters for the daily lives of trans and intersex people, outlines EU and Council of Europe standards calling for quick, transparent and accessible procedures, and highlights human rights concerns around psycho-medical requirements and pathologization. The aim is to show how Europeanization has influenced national frameworks since EU accession and why differences persist. Methodologically, the study conducts a comparative analysis of legislative documents from Malta and Romania, informed by Europeanization and queer theory, and situates the cases within the broader EU context. The analysis suggests that the two countries’ legal gender recognition rules are broadly comparable, yet shaped in different ways by historical, cultural and social factors; openness to Europeanization varies case by case.
