Abstract
Projektet undersøger kommunal ekspropriation efter Planlovens § 47, det vil sige når en kommune kan overtage privat ejendom til offentlige formål mod erstatning. Emnet har i flere år været præget af debat, lovændringer og forslag til nye regler, blandt andet på grund af mistillid til kommunernes praksis. Projektet gennemgår de centrale begreber og retsprincipper, der beskytter borgernes retssikkerhed, med udgangspunkt i sager afgjort ved Naturklagenævnet og ved domstolene. På den baggrund vurderer projektgruppen, at de gældende regler og praksis er tilstrækkelige, og at der ikke er behov for yderligere lovændringer. Dernæst undersøges de politiske forslag om at ændre kommunernes praksis. Her finder projektgruppen, at forslagene især er motiveret af ønsker om at påvirke erstatningernes størrelse frem for et ønske om at regulere selve ekspropriationsbeslutningerne.
This project examines municipal expropriation under Section 47 of the Danish Planning Act—that is, when a municipality may take private property for public purposes in return for compensation. For years, the topic has prompted debate, legislative changes, and proposals for new rules, driven in part by distrust of municipal practice. The project reviews the key concepts and legal principles that safeguard citizens’ rights, based on cases decided by the Naturklagenævnet (Nature Appeals Board) and by the courts. On this basis, the authors conclude that current rules and practice are adequate and that no further legislative changes are needed. The project then analyzes political proposals to change municipal practice and finds that they are largely motivated by concerns about the size of compensation rather than by a desire to regulate the expropriation decisions themselves.
