Specialet undersøger, hvornår adoption uden samtykke anses for at være til barnets bedste, ved at belyse både den politiske legitimering og socialrådgiveres praksisnære erfaringer. Med udgangspunkt i en todelt analyse kombineres en kritisk diskursanalyse af lovforslag L 105, inspireret af Carol Bacchis WPR-tilgang, med en praksisundersøgelse baseret på kvalitative interviews med socialrådgivere. Diskursanalysen viser, at adoption uden samtykke legitimeres gennem en problemfremstilling af et utilstrækkeligt anbringelsessystem, som ikke i tilstrækkelig grad sikrer stabilitet og kontinuitet for børn, samt en stærk orientering mod barnets perspektiv. I praksis står socialrådgivere over for komplekse og usikre vurderinger af barnets bedste, der indebærer vanskelige prognoser og afvejninger af tilknytning, biologiske bånd og langsigtede konsekvenser for barnet og dets familie; juraen er ikke alene tilstrækkelig, og det professionelle skøn bliver centralt i spændingsfeltet mellem modstridende hensyn. Specialet tager ikke stilling til, om adoption uden samtykke er rigtigt eller forkert, men viser, hvordan politiske rationaler gør indsatsen meningsfuld og hvordan disse oversættes og påvirker socialt arbejde med udsatte børn og unge.

This thesis explores when non-consensual adoption is considered to be in the child’s best interests by examining both its political legitimation and social workers’ practice-based experiences. Using a dual design, it combines a critical discourse analysis of legislative proposal L 105, guided by Carol Bacchi’s WPR approach, with a practice study based on qualitative interviews with social workers. The discourse analysis shows that non-consensual adoption is legitimized through a problem representation of an out-of-home care system that fails to ensure stability and continuity, alongside a strong child-centered focus. In practice, social workers face complex and uncertain assessments of the child’s best interests that require difficult prognoses and balancing attachment, biological ties, and long-term consequences for the child and family; legal criteria alone are insufficient, making professional judgment central amid conflicting considerations. The thesis does not assess whether non-consensual adoption is right or wrong, but instead shows how political rationales make the intervention meaningful and how these are operationalized and influence social work with vulnerable children and young people.
