Abstract
This thesis examines the Danish Social Democrats’ 2019 proposal to establish asylum centers outside Europe, to which applicants arriving in Denmark would be transferred for processing. It situates the proposal within a broader trend toward extraterritorial migration control and assesses the potential challenges for Denmark’s international obligations under the 1951 Refugee Convention. The analysis focuses on the principles of non-refoulement and non-penalization, applies the concept of extraterritorial asylum and the theory of neo-refoulement, draws on existing studies, and incorporates qualitative, semi-structured interviews with officials from the Ministry of Immigration and Integration and the Social Democrats’ Rasmus Stoklund to illuminate how a center might operate in practice. While the proposal aims to deter dangerous journeys across the Mediterranean and disrupt smuggling networks, the study identifies significant legal and practical uncertainties: it is unclear whether Danish standards of rule of law and safety can be guaranteed in a third country and how far Danish authority and jurisdiction could extend. Creating such centers may also complicate commitments to other EU member states, including the Dublin Regulation’s requirements for common frameworks and procedures. Overall, the thesis underscores that international commitments must be upheld and that numerous unresolved issues make implementation challenging.
