Abstract
Danmark, ligesom mange andre europæiske lande, fører en intens debat om immigration og flygtningekrisen. Som deltager i FN's Flygtningekonvention af 1951 skal Danmark behandle asylansøgninger fra mennesker, der flygter fra krig, menneskerettighedskrænkelser og katastrofer. Dette speciale vurderer, hvor godt danske asylregler beskytter asylansøgere, med FN's Verdenserklæring om Menneskerettigheder som målestok. Analysen ser på retten til at søge asyl, bevægelsesfrihed, familieliv og familiesammenføring, adgang til beskæftigelse samt non-refoulement-princippet (forbuddet mod at sende mennesker tilbage til steder, hvor de risikerer forfølgelse). For at forstå statens styring og kontrol af asylansøgeres liv anvendes Agambens 'biopower'-perspektiv. Denmark, like many European countries, is engaged in a heated debate about immigration and the refugee crisis. As a party to the 1951 Refugee Convention, Denmark must process asylum claims from people fleeing war, human rights abuses, and disasters. This thesis assesses how well Danish asylum policies protect asylum seekers, using the Universal Declaration of Human Rights as a benchmark. It examines the right to seek asylum, freedom of movement, family life and family reunification, access to employment, and the principle of non-refoulement (the ban on returning people to places where they risk persecution). To interpret how the state governs and controls the lives of asylum seekers, the analysis draws on Agamben’s 'biopower' perspective. The thesis also considers the sharp rise in applications in 2014 and asks why some asylum seekers chose Denmark amid intensified border securitization in Denmark and across the EU. Anthony Giddens’s structuration theory is used to connect individual choices with the social and political structures that shape refugee movements and destination decisions.
