Abstract
This thesis examines how far Section 132 a of the Danish Criminal Code extends in light of Article 10 of the European Convention on Human Rights, which protects freedom of expression. The provision has a very broad scope, covering the creation of new associations, gatherings of particular persons, and a wide range of statements and expressions. Under subsection 2, 'symbols' is interpreted broadly, including substitute symbols, number combinations, clothing, tattoos, and even paper drawings.
Specialets formål er at afklare rækkevidden af straffelovens § 132 a i lyset af Den Europæiske Menneskerettighedskonventions artikel 10, som beskytter ytringsfriheden. Bestemmelsens anvendelsesområde er meget bredt og omfatter bl.a. stiftelse af nye foreninger, forsamlinger af bestemte personer og en lang række ytringer. Efter § 132 a, stk. 2, skal 'symboler' forstås bredt, herunder stedfortrædende symboler, talkombinationer, beklædning, tatoveringer og endda papirtegninger.
