Abstract
I skrivende stund ser vi ind i en samfundsudvikling med et større fokus på individuelle rettigheder. Arkivloven giver borgere en betalingsfri adgang til egne oplysninger i records. Praksis anerkender i højere grad de borgere, som findes nedskrevet i arkiverne, og deres behov for at forstå myndigheders indgreb i deres liv. Denne tendens kommer i særdeleshed til udtryk i sager om tidligere anbragte. Specialet har til formål at undersøge de danske rammer for arkivsubjekters rettigheder over egne records. Ved hjælp af ‘the participant relationship’-model vurderes også potentialet for en udvidelse af rettighederne i dansk arkivpraksis.
The thesis aims to investigate the current Danish framework for records subjects’ rights to their own records as well as discuss whether Livia Iacovinos participant relationship model can be applied to Danish archival practice. The legal framework grants records subjects an undeniable right to access. Although archival practices are starting to recognise the needs of records subjects, the primary discussions have yet to consider records subjects as co-creators. As a consequence, the archives are left as the sole decision makers in regards to creation, ownership and use of records. A shift in power is possible through an application of the participant relationship model. The model centers the shared rights and responsibilities of both archives and records subjects. Danish practices manage to fulfill some strategies for such an application. However, a legal framework for shared rights is a prerequisite for most of the strategies. In conclusion, the participant relationship model does not have the necessary foundation for application in Denmark. Nevertheless, a discussion of the strategies provides inspiration for a revision of the Danish Archives Act. Linking the already existing rights-based approach with new ethical measures will ensure the person-centered ambitions of the inclusion of records subjects in the Danish archives.
