Specialet undersøger, hvilke udfordringer der opstår ved anvendelsen af byggeloven § 10 A, som kræver, at en ejendom med mere end ét enfamiliehus kan udstykkes i nye ejendomme. Først gennemføres en retsdogmatisk analyse for at afklare bestemmelsens anvendelsesområde og krav, herunder mulighed for udstykning og lovlig vejadgang. Derpå identificeres gennem interviews med tre landinspektører otte praksisnære udfordringer. Hovedanalysen bygger på ni cases og undersøger især, hvordan lokalplaner og kommuneplanrammer påvirker efterlevelsen af § 10 A. Casestudierne afdækker otte udfordringer, hvoraf fem er direkte relateret til planlægningen og har betydning for, om bestemmelsen kan overholdes: uenighed om antal boligenheder mellem kommune og bygherre, manglende plangrundlag, beregning af grundstørrelse, projekter i strid med lokalplan og projekter i strid med kommuneplan. Afslutningsvis generaliseres udfordringerne for at besvare problemformuleringen og tydeliggøre, hvor planlægning og praksis skaber barrierer for anvendelsen af § 10 A.
This thesis examines the challenges arising from the application of Building Act § 10 A, which requires that a property with more than one single-family house must be capable of subdivision into new properties. A doctrinal legal analysis clarifies the provision’s scope and requirements, including the need for subdivision potential and lawful road access. Interviews with three land surveyors then identify eight practice-based challenges. The main analysis draws on nine case studies to assess how local plans and municipal plan frameworks affect compliance with § 10 A. The cases reveal eight challenges, five of which are directly planning-related and influence whether the provision can be met: disagreement over the number of housing units between municipality and developer, lack of a planning basis, calculation of ground size, projects contrary to the local plan, and projects contrary to the municipal plan. Finally, the study generalizes the challenges to answer the research question and highlights where planning and practice create barriers to applying § 10 A.
