§ 47 of the planning law gives the municipalities the authority to expropriate according to the municipal plan or a local plan. To be able to realise a planning this provision is therefore of a central importance to the municipalities. Because of the increasing interest in establishing golf courses the expropriation for golf courses will be the basis for this project. The purpose of this project is to discuss this expropriation authority and especially the requirements which the expropriation must meet. This includes the constitutional requirements of legal authority, necessity and full compensation. These requirements provide the basis for this project. The requirement of legal authority will be subjected by explaining what an authority includes and which requirements are demanded on a legal expropriation foundation. Next the requirement of necessity compared to the expropriations of golf courses will be explained. This includes an overall study of the criterions which form part of the requirement of necessity to explain when they are met. Finally the requirement of full compensation will be subjected. The purpose is to discuss how to estimate the value of the areas which are expropriated into golf courses.
