This thesis examines the legal authority for expropriation in Section 47 of the Danish Planning Act, focusing on how expropriation is justified and implemented and on the legal and practical challenges that arise. Using a legal doctrinal approach, it analyzes legislation, preparatory works, case law, and assessment practice, drawing on sources such as Karnov and the official legal database. The study clarifies the concept of the public interest as a basis for expropriation and the role of proportionality, reviews the making of local plans and the expropriation process, including the role of assessment authorities, and addresses compensation determination with attention to general principles, expectation value, deduction for benefits, and compensation for disadvantages. Across these themes it identifies issues and offers recommendations.
