Specialet undersøger, hvordan dansk ret håndterer juridisk forældreskab i familiekonstellationer med tre forældre og de problemer, der opstår, når kun to kan registreres som forældre. Problemfeltet belyses gennem to hovedscenarier: den ikke-registrerede biologiske far samt regnbuefamilier med to fædre og en mor eller to mødre og en far. Med udgangspunkt i Børneloven gennemgås rammerne for registrering af faderskab og medmoderskab, herunder anerkendelse før fødsel, søgsmålsret, genoptagelse og behandlingen i statsforvaltningen og ved domstolene. Forældreansvarslovens formål og principper om barnets bedste, regler om forældremyndighed og samvær, herunder samvær for andre end forældre, samt mulighederne for stedbarnsadoption inddrages for at afdække de retlige konsekvenser, når en tredje omsorgsperson ikke har juridisk status. Metodisk bygger arbejdet på en retsdogmatisk analyse af love, forarbejder og administrative såvel som retlige procedurer for at klarlægge handlemuligheder, rettigheder og retlige tomrum i de beskrevne situationer. This thesis examines how Danish law addresses legal parenthood in family constellations with three parents and the challenges that arise when only two can be registered as parents. The analysis is structured around two main scenarios: the unregistered biological father and rainbow families comprising either two fathers and a mother or two mothers and a father. Based on the Children Act, it reviews the framework for establishing paternity and co-maternity, including pre-birth acknowledgements, rights to bring proceedings, reopening of cases, and procedures before administrative authorities and courts. It also considers the Parental Responsibility Act’s aims and the best interests of the child, rules on parental authority and contact (including contact for non-parents), and options for stepchild adoption to map the legal consequences when a third caregiver lacks legal status. Methodologically, the thesis applies a doctrinal analysis of statutes, preparatory works, and procedural pathways to clarify available remedies, rights, and legal gaps in the outlined situations.
