Specialet undersøger betingelsen om, at hævd (erhvervelse af en ret ved langvarig råden) ikke kan vindes, når råden strider mod offentligretlig regulering, og hvorfor praksis blandt landinspektører er uklar. Først opbygges en forståelsesramme for hævd og ejendomsberigtigelse, hvorefter problemets omfang belyses gennem en spørgeskemaundersøgelse blandt privatpraktiserende landinspektører og kvalitative interviews. Analysen peger på, at kun cirka halvdelen forholder sig til offentligretlig regulering ved konstatering af hævd. På den baggrund sammenstilles relevant empiri og retspraksis med henblik på at formulere en praktisk anbefaling. Afslutningsvis foreslås, at reglerne om hævd i Danske Lov kommenteres i en vejledende fremstilling, der samler domspraksis og anden relevant information, så landinspektørers praksis kan blive mere ensartet og korrekt.
The thesis examines the condition that acquisitive prescription (the acquisition of rights through long-term use) cannot be obtained when the use conflicts with public law regulation, and explores why professional practice among chartered land surveyors is unclear. It first develops a conceptual framework for acquisitive prescription and boundary rectification, then assesses the scope of the issue through a questionnaire survey of private practitioners and qualitative interviews. The analysis indicates that only about half consider public law regulation when determining acquisitive prescription. Based on this, relevant empirical material and case law are compiled to support a practical recommendation. The thesis concludes by suggesting a commented guide to the Danish Law provisions on acquisitive prescription that consolidates case law and other pertinent information to promote more consistent and accurate practice among land surveyors.
