Specialet undersøger, hvordan Lov om ansvaret for og styring af den aktive beskæftigelsesindsats udmøntes i kontrakter med private aktører i den kommunale beskæftigelsesindsats. På baggrund af et sporskifte fra forsørgelse til aktivering analyseres tekstlige dokumenter (lov, bekendtgørelse og en konkret kontrakt mellem et jobcenter og et konsulentfirma) med udgangspunkt i kritisk realisme og retroduktion. Teori om udlicitering, paradigmeskift i velfærdsstaten og viden om socialt beskæftigelsesarbejde anvendes til at identificere kausale mekanismer. Analysen struktureres omkring tre gennemgående temaer: udbud og marked, betalingsmodeller og incitamenter samt samarbejde. Specialet evaluerer ikke effekten af private aktører, men fortolker, hvordan lovtekst oversættes til kontraktlige vilkår, og fremsætter betingede, hypotetiske konklusioner om de sammenhænge, der kan medvirke til at forme implementeringen.
This thesis examines how the Danish Act on the responsibility for and management of the active employment effort is operationalized in contracts with private providers within municipal employment services. Against the backdrop of a shift from maintenance to activation, it conducts a critical realist, retroductive text analysis of legal and administrative documents (the act, its executive order, and a specific contract between a job center and a consultancy). Drawing on theory about outsourcing, paradigm change in the welfare state, and knowledge of social employment work, the study seeks to identify causal mechanisms. The analysis is organized around three themes: tendering and market dynamics, payment models and incentives, and collaboration. The thesis does not evaluate the effectiveness of private actors; rather, it interprets how legal formulations are translated into contractual terms and offers conditional, hypothetical conclusions about the relationships that may shape implementation.
