Resumé

Afhandlingen undersøger advokaters erstatningsansvar med fokus på culpavurderingens indhold, aftalens indflydelse og spørgsmålet om passiv identifikation. Formålet er at beskrive og analysere gældende ret om, hvornår en advokat ifalder ansvar, herunder hvordan culpanormen tilpasses opgavens karakter og kompleksitet: mere komplekse ydelser kan medføre en mindre stram vurdering, mens kerneopgaver for advokatvirket er underlagt en streng norm, og klare advokatfejl typisk udløser ansvar. Afhandlingen belyser også, hvordan kontrakten mellem advokat og klient kan afgrænse opdraget og indeholde ansvarsbegrænsninger, men at aftalefriheden i praksis begrænses af profesionsnormer, som hindrer fraskrivelse af ansvar for ydelser i fagets kerne. Endelig analyseres passiv identifikation, hvor advokatens uagtsomme adfærd kan reducere klientens krav mod tredjemand; her tillægges fuldmagtsforholdet, graden af uagtsomhed og klientens status betydning, og forbrugerforhold taler ofte imod passiv identifikation, hvorefter domstolene i stedet kan statuere solidarisk ansvar mellem advokat og skadevoldende tredjemand. Studiet anvender en retsdogmatisk metode baseret på retspraksis og juridisk litteratur og giver en samlet, systematisk fremstilling af ansvarsgrundlaget for advokatansvar.

The thesis examines lawyers’ liability for damages with a focus on the content of the culpa assessment, the influence of the lawyer–client contract, and the issue of passive identification. Its purpose is to describe and analyze the current legal framework for when a lawyer incurs liability, including how the negligence standard is calibrated to the character and complexity of the task: more complex services may lead to a less stringent assessment, while core legal tasks are subject to a strict standard and clear lawyer errors typically trigger liability. The thesis also explores how the contract can define the scope of the engagement and include liability limitations, yet freedom of contract is constrained by professional norms that prevent disclaimers for services at the heart of the profession. Finally, it analyzes passive identification, where a lawyer’s negligent conduct can reduce the client’s claim against a third party; factors such as the existence of an agency relationship, the degree of negligence, and the client’s status are important, and consumer cases often weigh against passive identification, with courts instead imposing joint and several liability between the lawyer and the injurious third party. The study uses a doctrinal legal method based on case law and scholarship and offers a systematic overview of the liability basis for lawyers.
